TERMS AND CONDITIONS

The contract holder is directly and jointly responsible for ensuring that the main driver or authorised additional drivers comply with the contractual obligations stipulated below while driving the rented vehicle.

Failure to comply with any of the obligations described below may result in the forfeiture of rights of the contract holder and, as a consequence, cancellation of the coverage taken out. In addition, the contract holder will be responsible for paying any damages caused to the rented vehicle and all expenses generated, which can reach the total excess amount.

If Falcò rent considers that any of the following obligations have been violated, it reserves the right to take the relevant legal action, such as taking back the rented vehicle from the driver of the vehicle and/or legally requiring the return of the rented vehicle.

1.1. Obligations of the contract holder and authorised drivers at the time of pickup:

  • The rental invoice will be made in the name of the rental agreement holder and, once the contract has been issued, it will not be possible to modify it. To request an invoice in the name of a company, the client must communicate this fact before entering into the rental agreement.
  • To inspect the vehicle before leaving the parking space and to inform Falcò rent of any discrepancies in relation to the vehicle’s condition described in the section of the contract “Annexe of damage information and verification”.  A discrepancy in the list of accessories present in the vehicle and damages that are not indicated or indicated incorrectly in the previously signed rental agreement.
  • To sign the ‘Pickup’ section of the “Annexe of damage information and verification” of the agreement as proof of acceptance of the condition of the vehicle at the time of pickup.  Signing the rental agreement implies the customer’s acceptance of the list of accessories present in the vehicle and of the description of the damages included in the section of the contract “Annexe of damage information and verification”.  Any damage that is not indicated in the contract will be considered to be new damage and will be attributable to the contract holder. In the event of breakage, loss or misplacement of the additional accessory or equipment marked as present in the vehicle, the contract holder will be liable for the replacement cost.
  • Where appropriate, to be responsible for the assembly of child car seats or any other extras that require assembly. Under no circumstance will Falcò rent assume any responsibility for the assembly of accessories in the rented vehicle.

1.2. Obligations of the contract holder and authorised drivers during the rental period:

To use the vehicle in compliance with the following terms and conditions of use:

    • To notify Falcò rent in the event of any technical failure in the rented vehicle: fluid levels (oil, water), tyre pressure, etc.
    • In the event of an accident, breakdown or engine failure, regardless of the coverage taken out, to follow the procedure established by Falcò rent:
      • Not to repair the vehicle without the prior consent of Falcò rent.
      • Not to request a breakdown service without the prior consent of Falcò rent.
      • Not to acknowledge or pre-judge responsibility for the incident.
      • Not to abandon the rented vehicle without the necessary means to protect it
      • To notify Falcò rent within a maximum of 24 hours of any damage (with or without a third party) caused to the rented vehicle.
        Falcò rent will assess the situation and determine the most effective solution: the driver will be recommended to drive to the office to pick up a replacement vehicle, the vehicle will be repaired at the location of the incident, or, if it cannot be repaired, a tow truck will be sent to tow the rented vehicle back to the nearest Falcò rent office and a replacement vehicle will be given to the contract holder.
      • In addition, only in the event of an accident, the driver must fill in the accident report, submit it to the Falcò rent office upon returning the rented vehicle and send a copy of the report to the e-mail address contact@falcorent.com. The accident report must indicate the circumstances, place, date and time of the incident, as well as possible witnesses and the full contact details of any involved third parties.

If the duly completed accident report is not handed in, or in the event of negligence by the client, Falcò rent reserves the right not to deliver a replacement vehicle.

In addition, the cover might become invalid.

Falcò rent will process the accident reports, notify the driver of the appropriate action to take. Falcò rent will charge the contract holder 50€ for this accident management, damage control, and advice service (DAF).  If the contract holder has taken out Top Cover, Falcò rent will not charge any fee for this service.

    • In the event of theft or robbery of the rented vehicle, regardless of the coverage taken out, to follow the procedure established by Falcò rent:
      • To immediately notify the relevant authorities and to file a police report and obtain the corresponding signed police report. If this document is not submitted to Falcò rent, the coverage may be rendered void.
      • To notify Falcò rent of the theft or robbery of the rented vehicle within a maximum of 24 hours.
      • To deliver the keys of the rented vehicle to Falcò rent within a maximum of 24 hours. If the contract holder does not deliver the keys, he/she will be responsible for paying Falcò rent the total excess amount of the vehicle. This clause shall only cease to apply if the police report indicates that the keys of the vehicle have been stolen.
    • Respect the road traffic regulations. Road traffic violations constitute an offence, and the driver may incur fines and penalties as provided for in applicable laws. Also, if the driver incurs a road traffic fine during the rental period, Falcò rent will charge the contract holder for the fine management and administration service for each offence/fine received (See more information in section 4.4).

The client is responsible for the proper knowledge and driving of the rented vehicle, especially with regard to the functioning of the gear changes. Any damage to the vehicle as a result of an error in changing gears will be considered as negligence. The contracted coverage will become invalid and the contract holder will be responsible for the costs generated.

    • Have sufficient knowledge to properly drive the rented vehicle

The client is responsible for the proper knowledge and driving of the rented vehicle, especially with regard to the functioning of the gear changes. Any damage to the vehicle as a result of an error in changing gears will be considered as negligence. The contracted coverage will become invalid and the contract holder will be responsible for the costs generated.

1.3. Obligations of the contract holder and authorised drivers when returning the rented vehicle:

    • To return the rented vehicle with its corresponding keys in the same working order and condition as at the time of pickup. If the contract holder returns the rented vehicle in a condition different to that specified by Falcò rent at the time of pickup in the section of the contract “Annexe of damage information and verification”, the contract holder will be responsible for any alterations produced and for any missing documentation or accessories, and, depending on the type of coverage taken out (consult the types of coverage offered by Falcò rent in section ‘4. Extras, accessories, charges and coverages’), may incur additional costs due to a violation of the contractual terms and conditions.
      • In the event of a breach or violation of the obligations and terms and conditions established in this rental agreement, the coverage taken out will be rendered void and the contract holder will be responsible for paying any damages caused to the rented vehicle, and all other expenses generated, up to a maximum limit of the total excess amount.
      • If the contract holder has taken out coverage with the provider of their bank account or with a third party, Falcò rent will charge the corresponding amount up to the excess limit of the contract holder’s bank card provided at the time of payment for the rental, and the contract holder will be responsible for claiming this amount from the provider of their bank card or from third parties.

The rental price includes standard cleaning of the rented vehicle. However, if the rented vehicle requires special cleaning, the contract holder will be charged the corresponding fee. Special cleaning constitutes any cleaning that requires more exhaustive action and involves taking the vehicle out of its standard cleaning routine. A special cleaning charge would be applied to the following examples: beach sand, animal hair, crumbs, rubbish left inside the vehicle (cans, bottles, packaging, etc.), upholstery stains, and stickers.

    • To ask Falcò rent staff to inspect the state of the rented vehicle and to sign the “Return” section of the “Annexe of damage information and verification” of the contract as proof of acceptance of the vehicle’s condition upon return.

If the contract holder does not request an inspection of the state of the rented vehicle, he/his consents and authorizes Falcò rent, if the vehicle has any alterations in its condition at the time of pickup and signing the contract, to charge the corresponding fee for the violation of any of the contractual obligations to the contract holder’s bank card provided at the time of paying for the rental.

    • To return the rented vehicle within office hours.

If the contract holder returns the vehicle outside of office hours, he/she must comply with the instructions of Falcò rent for returning vehicles outside of office hours.

A return outside office hours is understood to be that which takes place from 8 pm to 9 am.

The contract holder will continue to be responsible for the rented vehicle until the rental office opens again. If the contract holder fails to comply with the instructions for returning the vehicle outside of office hours, he/she will continue to be responsible for the rented vehicle until Falcò rent has access to the vehicle.

  • To return the vehicle to the agreed place, date and time. Falcò rent offers a 30-minute grace period for returning the rented vehicle in relation to its pickup time. However, this grace period must be determined and applied at the moment of finalizing the rental contract and selecting the vehicle return time.
    • If the rented vehicle is returned late, the coverage taken out will be rendered void and Falcò rent will apply a penalty fee of 20,50€ for each day of delay in returning the vehicle. In addition to this fee, the contract holder will also be responsible for paying the daily rental fee (consult the table of fees in section ‘4. Extras, accessories, charges and coverages’).
    • Falcò rent does not offer one-way rentals. The contract holder must return the rented vehicle to the same office as the pickup.  If the contract holder returns the rented vehicle to an office other than where the vehicle was picked up, Falcò rent will apply the corresponding penalty fee.
  • To inspect the vehicle before returning the keys and to make sure that no personal belongings have been left inside. Falcò rent is not responsible for the loss of or damage to any personal belongings left inside the vehicle during or after the rental period. The contract holder is solely responsible for this property.

1.4. Additional obligations of the contract holder and additional drivers:

Violation of any of the obligations described below will result in the loss of rights of the contract holder and, as a consequence, will render the contracted coverage void. In addition, the contract holder will be responsible for paying any damages caused to the rented vehicle and all expenses generated, up to the total excess amount.

  • Not to drive the vehicle while under the influence of alcohol, drugs, or any other substance that could affect the ability to drive. Falcò rent accepts no responsibility for any accidents or damages to property caused by the rented vehicle if, at the time, the driver was driving under the influence of alcohol, drugs, or any other substance that could affect the ability to drive. The simple fact of driving under the influence of any of the aforementioned substances will be sufficient cause for the contract holder to be held responsible for the damages causes regardless of whether the influence of the aforementioned circumstances has been demonstrated in the damage charges.
  • For the rented vehicle to be driven exclusively by drivers expressly authorised by Falcò rent in the rental agreement.
  • Not to drive the vehicle outside of Spanish national borders, or between different islands, or between islands and the peninsula. In this respect, is not allowed to transport the rented vehicle on a ferry or any other type of maritime transport. If this obligation is breached, Falcò rent will apply the corresponding penalty fee, the contracted coverage will be rendered void, and the contract holder will be responsible for all of the expenses generated, including the vehicle repatriation cost.
  • To fill the rented vehicle with the correct type of fuel, which is indicated in the “Vehicle information” section of the contract and also next to the fuel cap cover of the rented vehicle. Using the wrong fuel by mistake will constitute new damage and will be attributable to the contract holder.
  • Not to put water in the fuel tank. The presence of water in the tank will be considered a negligence and will be imputable to the holder of the contract
  • Not to drive on unpaved, unauthorised or restricted roads.
  • Not to drive with over the legal number of people for the type of rented vehicle.
  • Not to use the vehicle as a form of public transport for people.
  • Not to use the rented vehicle for illegal activities.
  • Not to use the rented vehicle to participate in races, competitions, or reliability or speed tests.
  • Not to use the vehicle for commercial purposes, as a courier service, or for the transportation of goods or people.
  • Not to sublease the vehicle.
  • Not to use the vehicle to tow other vehicles.
  • Not to use the vehicle for the transportation of animals.
  • Not to use the vehicle for the transportation of explosives.
  • Not to use the vehicle for the transportation of corrosive substances.
  • Not to smoke inside the rented vehicle. If the vehicle smells of tobacco smoke, Falcò rent will apply a penalty fee to cover the costs of processing, special cleaning, and vehicle suspension.
  • It is not permitted to disassemble or remove the seats in the hired vehicle.

2.1. Age requirements

    • Minimum age 25 years old

The minimum age for hiring a vehicle with Falcò rent is 25 years

    • Drivers of 70 years and older:

In the event any of the authorized drivers in the rental contract is 70 years of age or older, a surcharge will be added to the rental price for each driver who is in this age range.

2.2. Required documentation and information

Falcò rent does not assume any responsibility for accidents or damages to property caused by the rented vehicle if the contract holder has deliberately provided Falcò rent with incorrect information regarding their identity, home address, or validity of their driving licence.

Driving licences sent by fax or photocopies will not be accepted.

If the contract holder does not provide the documentation and information described below, Falcò rent reserves the right to refuse vehicle rental:

2.2.1. Identification document

    • The contract holder and all of the drivers included in the contract must present their national identity document, passport, or equivalent document as proof of identity.

If this document is not expressed in Latin script, it must be accompanied by an official sworn translation.

2.2.2. Driving licence

    • All of the drivers included in the rental agreement must present a valid European driving licence that is in date and which they have held for at least two year.

Exceptions:

For 25 years old bookings, the driver must be in possession of a driving licence for at least one years.

If this document is not expressed in Latin script, it must be accompanied by an official sworn translation.

Falcò rent assumes no responsibility for any road traffic fines incurred by the driver due to not having the relevant licence or licences to drive a vehicle in Spain. The driver is responsible for consulting and understanding the current regulations.

2.2.3. Addresses

The contract holder must provide Falcò rent with a local address (flat, apartment, villa, hotel, etc.) and also their home address in their country of residence.

Rate is available on the website. Cancellations are possible at any time. We accept credit and debit cards from recognized entities. The payment method must be issued in the name of a person present at the collection.

 

PREPAID RATE: ONLINE PAYMENT

Cheapest price. Payment by credit card at the time of booking or upon receipt of the booking acceptance email. The total value of the reservation (extras and taxes included) will be charged to the card used before the start of the rental.

Rate is available on the website. The rental price (plus other agreed fees, delivery service, etc.) will be charged in full for the agreed rental period for rentals of less than 3 days. Cancellations are possible at any time, free of charge, up to 48 hours before the pick-up date. Credit and debit cards from recognized entities are accepted. The means of payment must be in the name of a person present at the pick-up.

 

DIFFERENCES BETWEEN PREPAID RATE AND PAY LATER RATE

Our clients can reserve their rental vehicles based on the two rates. Among them is the prepaid rate (online payment), which offers a cheaper and safer price for customers with fixed travel plans. In the event of cancellation, we will charge a cancellation fee in accordance with the Terms and Conditions. There is no possibility of reimbursement even if the rental vehicle is not used. In case of cancellation, a cancellation fee of the amount of % of the total rent is withheld. To make sure that our clients have all the important information, our clients can contact our Customer Support, from where we will clarify their doubts.

 

 

 

One-day rentals: one-day rentals end at our closing hours at 8:00 pm. In case of a return, the next morning (9:00 am) an additional night supplement of 15€ will be charged.

For returns before 11:00 hs (11:00 am) and pick-up after 18:00 hs (6:00 pm), an additional nightly supplement of 10€ will be charged.

3.2. Our prices include:

    • Mileage:
      •  Unlimited mileage with free, mandatory inspection at 3000 km.

Vehicle inspection

The contract holder should visit one of the Falcò rent offices before reaching 3000 km for a mandatory free inspection of the rented vehicle.

This compulsory service is carried out to guarantee the driver’s safety. If the contract holder does not appear for the service before reaching 2,000 km, Falcò rent will apply the corresponding penalty. (Check the mileage service schedule in section ‘7.1.2.3. Mileage Services’).

    • Taxes and rates

VAT and airport taxes are included in our prices.

    • Basic coverage with excess

The basic coverage includes:

      • Coverage of collision damage and theft WITH excess (CDW and TP)
    • Full coverage without excess

The Total coverage includes:

      • Coverage of collision damage and theft WITHOUT excess (CDW and TP)
    • Free cancellation up to 48 hours before the rental for fee options that permit cancellations.

3.4. Our prices do not include:

    • Excess – amount liable for damage and other expenses with the Full Coverage
    • We have no fuel policy, you return the car with the same amount of fuel. No refunds of money are made for fuel.

4.1. Accessories

  • Child car seats:
    • The Spanish legislation in force states that all children equal to or less than 135cm must wear a restraint device in the vehicle adapted to their height and weight.
    • The contract holder is solely responsible for installing the child car seat. Under no circumstances does Falcò rent assume any responsibility for the assembly of child car seats in the rented vehicle.
    • If the child car seat is broken, lost or misplaced during the rental period, the contract holder will be responsible for paying an additional €100,00 replacement fee.

 

  •  GPS
    • Functions: GPS, map (even without connection)
    • If the GPS or any of its accessories are broken, lost or misplaced during the rental period, the contract holder will be responsible for paying the corresponding replacement fee.

4.2. Extras

    • Upgrade

The contract holder may purchase this extra at the desk to upgrade their vehicle.

 

    • Additional driver supplement

The contract holder may purchase this extra if he/she wishes to add additional drivers to the rental.

    • Price of the ‘additional driver’ extra: 15€/day up to a maximum of 45€

4.3. Coverage

4.3.1 Basic coverage

The insurance agreed by the rental company covers the renter and drivers authorized under this contract for civil liability (damage to third parties) to a limited amount, bail and any legal defense that may be required by the driver. Loss and robbery as well as damage caused to equipment transported inside the rented vehicle are excluded from the insurance cover.

Partial protection against damage to the vehicle itself (CDW): CDW is not insurance; it is optional protection that partially exempts the customer from financial responsibility for damage to the vehicle, collision or acts of vandalism, with the contract specifying the amount for which the customer is responsible.

By accepting to pay for super CDW+TP, the customer is exempt from financial responsibility for damage to the vehicle or for robbery. The cost of this protection varies according to the car group.

Under no circumstances does the insurance cover the following:

  • Damage, loss, breakage or theft of the vehicle’s keys or remote central locking; in the event of loss of these, the customer must pay for the costs of replacement (key, remote central locking and transport).
  • Any damage caused to tyres, wheel rims and hub caps will always be the responsibility of the customer.
  • Refuelling with wrong fuel. The customer will be responsible for the costs of emptying and cleaning the tank and fuel circuit due to incorrect refuelling.

In the event to accident

The renter will adopt the following measures in the event of accident:

a) Do not recognise or prejudge responsibility for the incident.
b) Obtain full details from the other party, and complete the mutual declaration of accident report.

  •  Names and addresses of people involved in the accident along with possible witnesses.
  • Place, date and time of the accident.
    – License plate(s) of the vehicle(s) involved in the accident, insurance company (companies) and policy number(s).
  • Attach to this declaration any police or court report, where there is any.

c) Do not abandon the vehicle without taking adequate measures to protect and safeguard it.
d) Immediately notify Falcò rent  of the incident.

In the event of accident, the customer will not have the right to a replacement vehicle or the return of any payment made.

    • Basic roadside assistance

The Roadside Assistance service included in the basic cover provides service until 8pm.

This service, which includes towing, recovery and roadside repair, will always incur a cost.

Exceptions. Services exempt from cost:

      • The towing service, only if there is no spare wheel or wheel repair kit in the vehicle.
      • Vehicle replacement at a Falcò rent office (subject to availability).

Please note that, if the customer requests assistance but then decides it is no longer needed, they should call the Falcò rent assistance number (+34 607 33 44 44) to cancel the service. If it is not cancelled, they will need to pay the applicable towing service rates to cover the costs incurred by the provider, according to the distance.

 

4.3.2 Top Coverage

The contracting of the TOP coverage includes all the assumptions except negligence and / or serious or very serious infraction. The price is € 10 per day.

 

4.3.3 Plus Coverage

If the contract holder takes out this coverage, the excess applicable to the basic coverage is eliminated. The pre-authorization amount corresponding to the reduced excess is 400 €.

Only drivers who are expressly authorised by Falcò rent in the rental agreement are covered by  the Plus Cover.

The coverage is only valid during the rental period. If the vehicle is returned late, the coverage is rendered void.

Plus Cover includes the following aspects:

    • Coverage of collision damage WITHOUT excess:

If the contract holder follows the procedure established by Falcò rent in the event of an accident, breakdown or mechanical failure (consult section 1. Obligations of the contract holder and authorised drivers in relation to the rented vehicle), he/she will not be responsible for paying any amount.

Is compulsory for the contract holder to take out Plus Cover to rent the vehicle.

4.4. Penalty Fees

    • Charge for loss or theft of keys

In the event of loss or theft of the keys of the rented vehicle, Falcò rent will apply a penalty charge of at least 305,00€.

    • Charge for use of the wrong fuel

In the event that a client fills the rented vehicle with the wrong type of fuel, Falcò rent will apply a penalty charge of at least 250,00€.

    • Charge for special cleaning

The rental price includes standard cleaning of the rented vehicle. However, if the rented vehicle requires special cleaning, Falcò rent will charge the contract holder 50,00€ or 150,00€ to cover the costs of processing, special cleaning, and suspension of the vehicle.

Special cleaning constitutes any cleaning that requires more exhaustive action and involves taking the vehicle out of its standard cleaning routine.

    • Charge for smoking inside the vehicle

Falcò rent does not permit smoking inside their vehicles. If the vehicle smells of tobacco smoke, Falcò rent will apply a penalty fee of 50,00€ to cover the costs of processing, special cleaning, and suspension of the vehicle.

An employee will check the vehicle with the lessee upon return and their claims will be taken into account. In case of disagreement with the assessment carried out, the lessee may submit their claims to the customer service e-mail address and, in case of disagreement with the resolution, go to consumer arbitration, whose decision the parties submit to for the resolution of such conflicts.

    • Charge for driving outside of the territory authorised by Falcò rent

If the “Cross-border” extra is not purchased and the vehicle is driven outside of the territory authorised by the company, Falcò rent will apply a penalty fee of 200,00€ in addition to the corresponding coverage cancellation and consequences stipulated in point 1 “Obligations of the contract holder in relation to the vehicle”.

    • Charge for one-way rentals

Falcò rent does not offer one-way rentals. The contract holder must return the rented vehicle to the same office as the pickup.  If the contract holder returns the rented vehicle to a office that is different to the pickup, Falcò rent will apply a penalty fee of 50,00€. In addition to this fee, the contract holder will also be responsible for paying the daily rental fee (consult the table of fees in section ‘4) Extras, accessories, charges and coverages’) and the vehicle recovery cost.

    • Charge for excess mileage

If the contract holder does not go to one of our offices to carry out the compulsory vehicle inspection after driving 2000 km, Falcò rent will apply a penalty fee of 2,00€/km. Maximum of  1000,00€ per rental.

    • Charge for returning the vehicle late

Falcò rent offers a 60 -minute grace period for returning the rented vehicle in relation to its pickup time. However, this grace period must be determined and applied at the time of finalising the contract and selecting the return time.

If the contract holder does not return the rented vehicle to the return point established at the time of finalising the rental agreement, the purchased coverage will be rendered void with the consequences stipulated in point ‘1. Obligations of the contract holder and authorised drivers in relation to the rented vehicle’ and Falcò rent will apply a penalty fee of 40,00€ for each day late in returning the vehicle.

In addition to this payment, the contract holder will also be responsible for paying the current daily rental fee (1) including the charges for the options purchased for each day late in returning the vehicle.

 

    • Charge for abandoning the rented vehicle

If the vehicle is abandoned, Falcò rent will apply a penalty fee of 200,00€. In addition to this fee, the contract holder will also be responsible for paying the daily rental fee (consult the table of fees in section ‘4) Extras, accessories, charges and coverages’) and the vehicle recovery cost.

    • Charge for returning the rented vehicle to a public car park

If the contract holder returns the rented vehicle to a public car park, if the vehicle is recovered on the same day as the return date established in the rental agreement, Falcò rent will apply a penalty fee of 30,00€. If the rented vehicle is not recovered on the same day as the return date established in the rental agreement, Falcò rent will apply the corresponding penalty fee for the late return of the vehicle, and the customer will be responsible for paying the vehicle recovery cost.

    • Fine management and administration fee (this does not include the amount of the fine)

If the driver incurs a road traffic fine during the rental period, Falcò rent is required by law to identify the driver and provide the authorities with his/her personal information in order to send the fine to the home address of the contract holder for its subsequent payment. For this management and administration service, for each offence/fine received, Falcò rent will charge an amount of 40,00€ to the contract holder.

This charge does not include payment of the road traffic fine. The contract holder will be solely responsible for paying the fine directly to the authorities.

    • Administration fee for the accident management, damage management and advice service (DAF).

In the event of an accident, the driver must fill in the accident report, submit it to the Falcò rent office upon returning the rented vehicle and send a copy of the report to the e-mail address contact@falcorent.com.

Falcò rent will process the accident reports, notify the driver of the appropriate action to take, and offer advice if they suffer any injuries and/or receive a court summons. Falcò rent will charge the contract holder 50€ for this accident management, damage control, and advice service (DAF).

If the contract holder has taken out Top Cover, Falcò rent will not charge any fee for this service.

An employee will check the vehicle with the lessee upon return and their claims will be taken into account. The customer will be informed of any corresponding charges in accordance with the aforementioned, and will be provided with documentation to justify said charges. In case of dispute, the lessee may submit their arguments by email to the customer service and claims department. If it is not possible to reach an agreement over the resolution, the lessee may present their claim to the relevant court or consumer authority.

No charge for fuel, simply return with the same amount that was delivered to you. No refund on unused fuel.

6.1. Modifications

Modifications before beginning the rental period

Cancelation the booking free of charge until 48 hours before the start of the rental.

It will also be possible to alter the booking if the modification has to do with the time of picking up and/or returning the vehicle (provided there is no change of days).

You can request to modify your reservation using the CONTACT section, specifying the date and booking number, our staff will be able to modify them, then we will proceed to send you confirmation of the updated data. If you are already enjoying a rental in progress, you can manage it by calling our office and it will be subject to vehicle availability.

 

Restrictions

  • It will not be possible to make changes related to the booking holder, the vehicle group hired, the rental dates, the number of rental days, or the extras contracted. In these cases, the booking will need to be canceled and a new one made.
  • Bookings that include a discount cannot be modified. The booking will have to be canceled, and a new booking will have to be made.

Modifications during the rental period

If the customer wishes to retain the rented vehicle for longer than the time established in the contract, he must inform Falcò rent and sign a new agreement with payment of the corresponding amount. The vehicle will be returned in the place and on the date stipulated overleaf. Any change in this respect must be previously authorized by falcò rent. Non-compliance with this condition will entitle the rental company to require the legal return of the vehicle. Furthermore, the agreed rate at the start of the rental is conditional upon the vehicle being returned at the place and on the date specified.

6.2. No show (uncompleted rental)

If the customer does not appear at the desk on the date and at the time selected when making the booking, Falcò rent will not refund the amount of the booking.

The customer has a grace period of 24 hours to get to the rental office after the pickup time indicated in the booking, after which time, the booking will be canceled and considered a ‘no show’. This condition is always subject to vehicle availability.

6.3. Vehicle late pickup

Should the vehicle pick-up be late due to a flight delay, if the customer expects to be more than an hour late, they should notify Falcò rent of the delay by sending an email to clientes@falcorent.com or by calling (+34) 607 33 44 44. Should the person who made the booking fail to inform Falcò rent of their flight delay, Falcò rent cannot guarantee that the vehicle will be available for pick-up.

6.4. Vehicle return

Vehicle return during office opening hours

You must return the Vehicle to the Falcò rent office indicated in the Rental Agreement, and on the date and time established in said Agreement.

The Rental Period will end when you return the vehicle to the Falcò rent office and hand over the keys and documentation of the Vehicle to a Falcò rent employee. We will not make any refund in the event that you return the vehicle before the date and time agreed in the Rental Agreement.

Falcò rent is not responsible for the properties and/or objects that you may have forgotten inside the vehicle.

 

Return of the Vehicle with delay

In the event that the vehicle was not returned on the date indicated in the Rental Agreement and after a period of 24 hours has elapsed without having heard from you, Falcò rent may consider that the Vehicle has been subject to misappropriation, reporting it to the competent local authorities.

In such case, Falcò rent will have the right to claim all the damages and losses caused to Falcò rent, as well as all the fines, penalties, or sanctions that fall on the vehicle leased as a result of the requests made by public administrations with the purpose of identifying the violator of those or to clarify other circumstances in relation to possible infractions or crimes.

Falcò rent will also have the right to initiate legal proceedings in order to demand the immediate return of the Vehicle. In such cases, protections and other additional contractual services will have no effect.

6.5. Early vehicle return

In the event of an early vehicle return, Falcò rent will not charge the contract holder any penalty fees. In addition, the contract holder will not be reimbursed for any days on which the extras have not been used.

7.1. Payment methods

  • American Express, Visa, and MasterCard credit cards.
  • Debit cards are also accepted depending on the vehicle and rental conditions.

 

    • Prepaid cards are not accepted
    • Payment via smartphone, check or transfer is not accepted.
    • The holder of the bank card with which the rental payment is made must be the holder of the contract and he must be present at the pick-up date.
  • In the event that the contract holder is not the main driver, Total Coverage must be contracted.
    • The contract holder can carry out several rental contracts with the same card on the condition that in the rental contracts in which the contract holder is not the main driver, they take out Total Coverage.
  • The payer will be responsible for knowing the PIN of his bank card.
  • The customer must ensure that their bank card has sufficient funds at the time of the vehicle collection to be able to collect the rental with all the contracted options and, in addition, if applicable, block the amount of the pre-authorization corresponding to the group of the rented vehicle.

At the pick-up date and rental payment, Falcò rent will charge the rental charges to be paid at the counter on the contract holder’s bank card and will block the pre-authorization in the form of a deposit corresponding to the type of rented vehicle.

 

Cash payment

Only exceptionally will cash payments be accepted, and at the time of collecting the vehicle it will be necessary to:

  • Leave a cash deposit, which will be reimbursed upon the vehicle’s return, unless there is a breach of contract or additional obligations are created according to the general terms and conditions of the contract. The amount of the deposit will be that which is specified below according to the type of vehicle.
  • Make a photocopy of the lessee’s ID card, passport, driving licence and a credit card (visa or Mastercard), who authorises the company to keep this documentation for the purposes of complying with the obligations arising from the contract and to put on such card any charges resulting from the fulfilment or breach of contractual obligations.

7.1.1. Restrictions and considerations related to payment

  • Pre-payment cards are not accepted
  • We do not accept smartphone payments, cheques, or banks transfers.
  • The holder of the bank card used to pay for the rental must be the contract holder and must be present at the time of making the payment.
  • Only one bank card can be used per contract and the card must be non-transferable.
  • It is compulsory to take out Top Cover if the contract holder is not the main driver.
  • The contract holder can purchase multiple rental agreements with the same card provided that the contract holder is not the main driver in the rental agreements and Top Cover is taken out.
  • The payer is responsible for knowing the PIN number of their bank card if they are paying with a card that includes this technology.
  • The payer must ensure that the bank card has sufficient funds at the time of picking up the vehicle to pay for the rental with all the selected options, and, where applicable, to block the pre-authorization amount corresponding to the group of the rented vehicle.

 

7.2. Payments and blocking at the time of pickup

When collecting the vehicle and paying for the rental, Falcò rent will charge the rental charges to be paid at the counter on the bank card of the contract holder and will collect the amount of the deposit corresponding to the type of vehicle rented.

The deposit is used to cover additional expenses that may arise (overtime rental hours or days, vehicle abandonment charge, damage.)

The amount of the deposit can be blocked (on credit cards) or charged (on debit cards).

If the deposit is deposited with a credit card, the blocking time will depend on your bank (the average is usually 10 days, but it can go up to a maximum of 30 days from the start of the rental).

If the deposit is collected with a debit card, the maximum time for its return will be 15 days (from the date of return of the vehicle), although most unlocks are made in less than 10 days.

9.1. Data protection

Falcò rent hereby informs that the personal data obtained to conclude the rental agreement will be contained in a file owned by the company for the purpose of providing this service. Customers can exercise their rights to access, rectify, cancel and oppose this data by sending a request by email to lopd@falcorent.com, attaching, in each case, a photocopy of their national identity document, passport, or equivalent document.

9.2. Legal system and code

The rental agreement is governed by the terms and conditions described in the previous points and by the following and related articles 1.554 of the Spanish Civil Code on the subject of leasing. In the event of any divergence arising between the Lessor and the Lessee, these parties agree to submit to the relevant courts of law.

9.3. Reservation of rights

Falcò rent reserves the right to refuse the rental of vehicles to customers that violate any of the conditions or obligations established in the present document.
